Terms of Business (Clients)
Terms and Conditions (as they appear in our contracts):
1) These Terms and Conditions of business regulate the Assignment requested by the Client for Feature Music to arrange a
Musician for.
2) These Terms and Conditions are deemed to be accepted by the Client by the return of the signed copy of the agreement as
well as the Fixing Fee to Feature Music within 7 days of the provision of the same to the client. These Terms are required to
be signed prior to any Musician undertaking an Assignment.
3) Feature Music undertake to match Musicians to the Client’s requirements and fulfil any specific requests made.
4) All negotiations, queries regarding an Assignment including payment, music requested and rehearsals must only be
undertaken with Feature Music and not the Musician;
a. save for any queries in relation to musical issues on the day of the Assignment must be addressed to the Musician
first, and if not satisfactorily resolved addressed to Feature Music.
b. If for any reason the Client has cause to complain as to the Musician’s conduct, they must raise it in writing within 3
days of the Assignment start date or particular incident. Feature Music will consider if a refund of the Payment
Amount is applicable but there will be no contractual right to a refund.
5) The Client is responsible for ensuring:
a. The Musician is aware of any particular rules or regulations including Health and Safety compliance, licence
requirements as to music on the Assignment relevant to their particular venue or needs.
b. The Client has a responsibility to ensure the Musician is working in a safe working environment, for the avoidance
of doubt if there are any particular requirements the Client can obtain the Musician signature to any policy/briefing
to confirm they have had a health and safety meeting at a relevant venue.
c. If the Client is providing any music they are responsible for the appropriation of the relevant permission such as
copyright for the Musician to perform that piece of music. The Performing Rights Society can assist in the same.
d. If the Musician or Feature Music are concerned as to the relevant permission and if not addressed by the Client, the
Musician can refuse to proceed and neither the Musician nor Feature Music are responsible for any losses incurred by the Client.
6) Should it be deemed that the Client finds any Musician unsuitable for whatever reason; the Client must first address the
matter with the Musician on the day if there is any changes that could be made such as to musical issues.
7) The parties agree to keep the contents of the Terms and any other confidential information confidential including not
releasing any financial information to the Musician.
8) Any music provided by the Client will be returned at the end of the Assignment.
9) Any recording required of the musicians must be agreed in writing in advance between the Client and Feature Music, subject
to an additional charge. .
Payments:
10) The Client agrees to pay Feature Music the Payment Amount being 80% of the Total Booking and the Fixing Fee being 20%
of the Total Booking as confirmed in clause 18 below for the provision of their services in arranging and placing the Musician.
11) The Fixing Fee of 20% of the Total Booking plus the signed copy of this agreement is required to be received by Feature
Music within 7 days of the provision of this agreement to the Client:
a. Only upon receipt of the Fixing Fee and signed agreement will your booking be secured. Failure to provide the
Fixing Fee and signed agreement within the 7 days, will result in the provisional booking being released and
Feature Music will not be required to honour the booking.
b. The Fixing Fee of 20% of the Total Booking will be a non-refundable deposit and will not be returned if the booking
is later cancelled, further financial defaults will occur as per paragraph 13 and 14 below.
c. Any Assignment booked with less than 7 days’ notice will require the Total Booking amount (being the full Payment
Amount and Fixing Fee) to be payable on the return of the Agreement securing the booking.
d. If the Assignment is booked with more than seven days’ notice the:
d.i. Fixing Fee is required to be paid with the signed agreement within 7 days of the provision of
the same.
d.ii. The Client agrees to pay Feature Music the Payment Amount as specified below at least 7 days
in advance of the Performance Date, exact dates are set out in the Individual Terms below.
12) Failure to provide the full Payment Amount by the Payment Date will be considered by Feature Music as a breach of this
contract,:
a. they will be able to take legal action against the Client without any further notice to recover their losses;
b. also any costs incurred in recovering the Payment Amount will be claimed against the Client.
c. Result in the non-attendance of the Musicians as a result of the client’s breach of contract.
d. Will be treated as a cancellation under clause 13 b, where the full Payment Amount will be recoverable as well as
any additional damages caused as a result of the loss of the booking.
Cancellations:
13) Any cancellations by the Client must be made in writing to Feature Music (at the address above) at least 30 days in advance.
Any cancellation will automatically be subject to a cancellation fee of 20% of the Payment Amount on top of the Fixing Fee
non-refundable deposit:
a. If the Assignment is cancelled by the Client within 15 days of the Performance Date then 50% of the combined
total of the Payment Amount and Fixing Fee will be payable to Feature Music.
b. If the Assignment is cancelled by the Client within 7 days of the Performance Date then 100% of the combined
total of the Payment Amount and Fixing Fee will be payable to Feature Music.
14) In the unlikely event of illness/ unavailability of the Musician assigned the Client agrees for Feature Music to provide a
substitute Musician of a similar standard.
15) In the unlikely event of the Musician not fulfilling the full performance time due to a time scheduling out of their control, no
reduction in Payment .
16) The Client shall ensure the Venue used has the appropriate licences and permissions for the event to take place.
17) The Client is responsible that any venue used has relevant public liability insurance.
